The Supreme Court handed down a landmark ruling on Monday regarding presidential immunity. The Supreme Court’s ruling has generated enough hysteria to melt the polar ice caps. Some of the absurdest claims are that presidents now have the power to order assassinations of political rivals.
A Supreme Court Justice has commented on this stupidity. Those who will have to carry out such an order, and especially the elite Delta Force in the US Army, may hold a different opinion.
It is common to ask a candidate, and former Delta personnel to tell me about it.
It is reasonable to assume that this question will be asked of all candidates who apply for the Naval Special Warfare Development Group, also known as SEAL Team Six and the Air Force 24th Special Tactics Squadron. The three special mission units of the Joint Special Operations Command consist of these organizations.
Sonia Sotomayor, a Supreme Court justice, dissented on Monday’s ruling about presidential immunity. She asked: What does the ruling mean to a president who “Orders Navy Seal Team 6 to assassinate a political rival?” She responds, “Immune “.
To put it more pleasantly, Justice Sotomayor is full of crap and has a profound and fundamental misunderstanding about the military’s function.
Sotomayor is wrong on both counts. Her argument is intellectually dishonest, and her legal reasoning is flawed. Legal scholars will not claim that a president can legally kill an opponent at home. This is because the law on lawful orders states that it must be based upon a “military duty”. A domestic assassination, however, would be a political and criminal act.
According to the United States Constitution, the president does not have the authority to assassinate his political opponents. Military members are not bound to obey such an order. The oath that all military members take requires them to refuse.

The military swears loyalty to the Constitution and not to any leader or government. The purpose of this is to stop an American Caesar rising who would have a loyal army to him and not to the nation.
I, like most military personnel no longer in active service, hold the oath of allegiance to be a high honor.

It seeks operators with moral conviction and competency, not those who adhere to the corrupt Praetorian Guard tradition from the first century. Delta DEVGRU, and the 24th STS, are the exact opposite of what Sotomayor thinks she wants.
Military personnel are no different from the rest of us. They can turn against their countrymen in times of national crisis or chaos. It would be both illegal and un-legal since there is nothing in Trump v. United States that makes this possible. The speculation of the left on the legality of political assassinations fuels divisions and could lead to a split like the one described.
The President cannot order the assassination of political opponents. This has never been allowed. This will never be permitted. Justice Sotomayor, and her many left-wing colleagues, are more full of beans than Aunt Marilyn’s famous mashed potatoes.
